View Full Version : legal Question.....
FunGusAmonGus 05-28-2007, 15:09 Lets say your out fishin on a 70 acre lake all by yourself. This guy comes 1/2 mile across the lake in a boat and starts fishin about 30 feet in front of you in the spot you have been fishin the whole time. If you "accidently" sink a hook in him are you liable??????
just move. That's the nice thing to do. If they follow you shoot them. Say you were being stalked...

just move huh.....Well I have come to the conclusion if you don't mess with people for the most part they won't mess with you.Seeking someone out on a 70 acre lake, coming straight from the boat ramp to where the person is fishing and castin five feet in front of them is messing with someone.
This was an issue when I lived out west. We would drive along a river and if there was a car in the pull off we'd go on until we found a suitable stretch as to not infringe (as would the other Montanans, Montanites, Montanananans??? I don't know...). We always knew the tourons. as they would come stand right next to you. They just don't know how to do it on their own. Feel sorry for them.
These were the same folks that were looking for great pics in Yellowstone. We'd point at a raven and say "OOhhh the rare black eagle"...SNAP SNAP SNAP That was mean...and I am sorry... (no I'm not...)
Smokey Mc Pot 05-28-2007, 17:06 just dont move and if he keeps getting so close tie on a weight and throw at his boat and he will learn soon enough
I've had to deal with this in the past, if I'm in a spot by myself (I'm not talking about places where crowded fishing is a way of life, like Mauntak) and someone moves in close enough that our lines may get tangled, I make sure they get tangled as much as it takes for him to get the hint that there's not enough room for both of us in this spot, I just keep casting across their line and apologizing, "I'm sorry I'm kinda new at this", this usually gets a snide remark but they do move on. some of you may think this is a rude way of dealing with the problem, but a person that would move in on you that close when there is plenty of room needs to be dealt with in a manner that they will understand.
maybe someday I'll tell ya'all about "The Baldwin Theory" a technique I perfected back in the early 80's for fishing the bank at Baldwin in the winter.
FunGusAmonGus 05-28-2007, 17:51 well my "friend" who had this happen to him put a spinner in the boat right behind the guy and popped it out up over the side then he started to foul the guys line. The guy in the boat started to say something and my "friend" said to him "did you come all the way over here to fish or bitch" He finally got the hint.

Does it work at the spillway below Carlyle too? If so, I'd like to hear it. Inquiring minds want to know.
Smokey Mc Pot 05-29-2007, 09:44 well if your bow fishing dont be shooting your arrow across there arrow cause they might get a little ticked off then you have the whole indian thing going on down there

That is one of the funniest things you ever came up with Smoke...:p:D
I think wed all like to hear your theory on Baldwin
Hah, was browsing and seen this thread....
Had that happen to me and my daughter a couple of times... Fortunately my daughter has a loud voice and doesn't like to be crowded while fishing...I just let her voice her oppinion and gennerally people start moving away:D

Since shooting them might be illegal just pop a couple holes in the hull, thy won't have time to come at ya or the boat may sink and by the time they get it loaded you can be gone.
Or find a lure with at least three giant treble hooks and send it within feet of his head on "accident."
Fun, you must have been fishing the best hole on the lake.
I had this happen to me one time on Rend while fishing Jackie Branch. I was set up on some X-trees the Corp puts out fishing for crappie. Three guys come out of the ramp and head straight towards me and pull up 30 feet from my boat and just sit there not fishing. Heck theres 19,000 acres to fish. After 5 minutes of this I fired up my outboard and let it rev till it about throws pistons before I gunned it out of there leaving a huge wake.
bigpappy 03-27-2009, 09:13 Though I do not beleive in mud ducks since I don't beleive in poaching, or wasting a perfectly good duck- I think the principals of a mud duck could be applied to this situation with a favorable outcome for you fun!
You can always crank up the boat motor and hole shot it right in the area he's in then find somewhere else to catch em and show him at the dock all the fish you caught. If the follows you elsewhere then tie on a large weight and start flinging it at his head. j/k
